Authorize Others to Access Your Account

If you've chosen people to manage your affairs or help you in the event you become incapacitated or pass away, add them to your Via Benefits account as authorized representatives. This allows us to speak to them if you're unable to manage your account yourself.

  • Complete the Authorization to Release Protected Information if you want us to share account information with a family member or friend.

  • Add a Financial or Durable Power of Attorney (POA) to allow us to speak with your POA about your account.

  • Authorize an Executor of Estate. Your Executor is responsible for making financial decisions associated with your estate after your death.

Authorization to Release Protected Infomation

The Authorization to Release Protected Information (ARPI) has two levels of account privileges, limited and full.

  • Limited - Allows sharing protected health information (PHI) with the representative, but prevents the representative from making changes to the account.

  • Full - Allows sharing PHI with the representative and allows the representative to make changes to the account. This is important if the representative manages funds or banking.

You can authorize access to your account information anywhere from a single day up to indefinitely. Because sensitive information is made available to these representatives, we encourage listing only your most trusted advisors as indefinite authorized representatives.

An authorized representative with an ARPI may not complete an enrollment or the scope of appointment on your behalf.

Power of Attorney

A POA is a legal document that gives someone you choose the power to make legally binding decisions in your place. An ARPI isn't required if you have a POA.

POAs and other legal documents accepted by Via Benefits: 

  • Durable POA

  • Guardianship

  • Conservatorship (Conservatorship paperwork must specify the ability to make financial decisions)

  • Financial POA

With a valid Durable POA or Financial POA, the person you name is legally permitted to take care of important matters if you're unable to do so. These matters may include completing enrollment applications on your behalf or managing your reimbursement account.

Via Benefits can't help you obtain a POA or provide legal advice. Seek legal counsel if you need to establish a POA.

Prepare Your Account for Your Passing

Via Benefits’ policy allows a valid Durable Power of Attorney, Guardianship or Conservatorship on file prior to your passing to act as Executor of Estate after your death. Your Executor is responsible for making financial decisions associated with your estate. An Executor generally contacts Via Benefits to submit existing reimbursement requests to exhaust the funds available in your reimbursement account.

If you don't have an authorized representative on your account, we require legal documentation before we can assist your representative. An Authorization to Release Protected Information form needs to be completed by the legal representative of your estate (Executor of Estate or Administrator of Estate). The form must be returned along with proof the individual requesting the release is the legal representative of the estate.

An Executor may be designated on one or more of the following documents:

  • Executor of Estate

  • Administrator of Estate

  • Probate

  • Trust

  • Last Will and Testament

All pages of the document are required.

Call us to add an authorized representative or a POA to your account. A Via Benefits representative asks a few questions, reads a statement, and collects your verbal agreement authorizing the appropriate type of representative for your needs. There’s no form to fill out unless you can’t come to the phone.

If you’re incapacitated or unable to come to the phone and verbally authorize your representative, we can email you or your legal representative an Authorization to Release Protected Information Form to fill out. 

Your legal representative can complete and return the form along with the legal documentation of representation (for example, Durable POA, Guardianship or Conservatorship). The legal documents need to be sent to us for review before the POA can provide assistance. 

You can send legal documents to us by email or mail. Please clearly provide the participant's name and date of birth on the documents. We're unable to associate the document with the participant's account if we can’t identify the participant on the document
